realistic. >> setting the expectation really, really low. i think they are deliberately doing something they are relatively confident they can achieve. even if they hit that 80% mark. still as you point out that's still a c. still ignores the fact that the law is under if mentally flawed. in other words, for years, many of us have been looking at this law and saying this thing is headed off a cliff. no matter how well the train is running, as it heads towards the cliff. if you know it's going to go off the cliff at some point, that's the probable we ought to be focused on. >> i fully expect the web site to be up and running at some point. it may be november 30th or december 30th and go through all sorts of hardships. one thing i do not understand is how are we funding this? where are we getting the money? i know there are little taxes here and little taxes there. if the healthy young people don't come in droves, is this thing going to collapse? >> yes. it will collapse and i think it is destined for collapse and i think most people in the administration acknowledge it's going to collapse. the difference is that a lot of people within the

administration and people like harry reid have acknowledged that if but when it does collapse, they hope that we will quickly move towards a single payer healthcare system. that's one of the many problems with this law is that it was built to fail it was built to fail knowing that it would fail and as it failed it would harm many millions of americans. hard-working americans who would lose their jobs and lose their healthcare. >> so what is the solution? i know that you don't like obamacare. i know you want to repeal it but in recognition of where we are, and how we try to inflict the least amount of pain on americans and especially -- i mean, the ones i'm really worried with are the ones who either don't have the or who are sick. >> he yes. i think there are ways that we can deal with those. >> how? >> we have got to suspend obamacare in its entirety. i don't think we can just start part of it. i don't think the president has authority. constitutionally or statutorily to just suspend one part of the law. i think we have got to suspend the whole law and go back to congress and allow congress to introduce additional ideas. new ideas. >> what -- i mean, give the

people, you know, some idea of what there is out there. you know, what the american people hear, they either hate obamacare or love obamacare. one thing we know is that republicans don't like it and want to repeal it. if there were no obamacare, you know, what could you do? what could you pass? how could you make it better for the american people? >> first of all, if there were no obamacare at you will, the discussion might be different than it is today. we are facing obamacare so we have got to deal with where to go from that. there are republican proposals. proposals that haven't yet gotten a lot of attention but are going to start getting a lot of attention soon. one was released recently by the republican study in the house of representatives. it calls for a system of tax credits that would enable americans to buy health insurance with some government assistance. but it would leave the decision-making power in the hands of the american people rather than in the hands of government bureaucrats. >> when you hear about tax credits and subsidies first of all i think it goes to the american people. then what i realize it is a guaranteed payment to the insurance companies. isn't that what he they're? >> yes, perhaps.

but, again, we have to start not with the government we wish we had but the government we, in fact, have. and with obamacare on the table. that looks like a much better alternative to turn to something like that rather than this. allowing the american people to use their own decision-making power to figure out where best to get their insurance. and it would also incorporate certain ideas regarding the portability of insurance. that you could buy insurance across state lines, that you could carry it from one state to another as you moved. and you could carry it from one job to another. >> how are the insurance companies doing these days? are they doing pretty well? >> i think they are pulling their hair out right now. >> not the chaos but financially? >> financially i think they are doing well. and i think that they expected to do well under obamacare. and that's why a the lo of them either sat quietly or, in some cases, sat loudly cheerleading from the sidelines as this law was being debated. >> the reason i ask is because as i look deeper and deeper in this bill. it's rather complex. i see certain advantages to the insurance companies.

i mean that they are -- if you look at each the credits. is that they are guaranteed their payment. and when i practiced law if i the government guaranteeing my payment that's not bad. it's a good deal. >> it's a good deal for them. that's why a lot of them were cheering from the sidelines, encouraging congress to pass. this i think a lot of them have buyer's remorse now that they are seeing that the law isn't what it was sold as and the law is being modified again and again and again by a president who has no statutory authority to revise acts of congress. and he has no constitutional authority to do that either. >> what would you like the president to do at this point? i mean, here is the law. he can't repeal it himself, right? >> he can't repeal it himself. what i would like the president to do is to acknowledge what the american people are already seeing which is that in this law is not ready. this law was ill conceived in the outset and this law should be suspended. he should go to congress and ask congress to suspend it for at least a year while congress figures out a way forward. >> the house will do that and the senate?

>> if the president asks them to do it. i believe the senate would comply. >> well, senator harry reid, he certainly is a champion of obamacare. >> he is the champion of obamacare. and the democrats in the senate, including harry reid have generally tended to do what the president has asked. especially with regard to obama care. for that reason if he asks for it i think they would do it. >> it does seem that there are some democratic senators who are starting to feel a little raw around the edges like senator landrieu of louisiana and senator of new york gillibrand seems unhappy too and shaheen. a cup of them. >> there they are thought alone. feeling pressure from constituents and getting calls from constituents every day saying please, help me, i'm hurting under this law. i have lost my job or losing my health insurance. >> the washington, d.c. insurance commissioner gets fired. we talked about that a second ago. wait until you find out when and why he got fired. we're curious what you think about his firing after you hear the facts. commissioner. >> thank you. >> nice to see you. what happened what his name. >> william white. president obama said to quell some of this dissent we will let everyone who has lost their insurance keep it for another year. three or four hours went by and he began to met with deputies and came out with a statement saying i don't think that's the right plan. that will undermine everything we have been doing in d.c. for three years. we would like to hold the course, probably owe -- he left himself a little bit of willing wiggle room opposed the idea of backtracking and things got worse. >> he dissented by putting on the public web site for the district of colombia. >> yes. >> did he notify the mayor? >> here is the rub. he put the statement out, sent it out to his staff and put it up on the web site and sounds more like a courtesy cc to the mayor's office. his stance is i'm the regulator. i talk to the insurance industry. i try to calm the market. and so he put out this statement and told the

mayor. but, didn't give him very much warning. in fact, was out before there was any response from the mayor's office. >> so, how soon after did he hear from the mayor's office? >> about 20 minutes later he got a call from the mayor's chief of staff. >> saying? >> saying why did you put this statement out here? pretty intense exchange went on for about five hours behind the scenes. at 11:00 that night, he sent out an apology saying, you know, i didn't realize this was going to be such a political hot potato. next day goes to work and about 4:00 is called in the deputy mayor's office and is told that he is fired. >> so the mayor didn't do it himself. >> he didn't do it himself. >> probably -- i assume it came from the mayor, right? >> all expectations are that it came from the mayor. >> is there any indication the mayor has any relationship with the white house or got a phone call? do you see any fingerprints whatsoever on this by the white house? >> that's kind of been -- that's kind of been the question we have been trying to chase this story so hard

because that would be where your mind would naturally go. but there is no evidence of that so far. there is really just an issue where someone didn't get to go through the proper channels as best we he can tell. and i think -- >> -- but he went through the proper shams. it's his authority put out a statement. it's just that the mayor didn't like what he said, right? >> true. >> so the mayor fired him? >> he does serve at the pleasure of the mayor or did serve at the pleasure of the mayor. >> so the mayor looks like -- has the mayor made many public statements like then like i acted rather or anything. >> he hasn't said anything. his first public appearance today i asked him why he fired him. he said no comment. it's a personnel matter. so that's a statement from the city. i think if there is a take away, perhaps, it is that it has put insurance commissioners in these states and the district in a very precarious position. the day of obama's announcement, the insurance

okay, it's no secrets, the labor unions went hog wild and helped get obamacare passed and now suddenly two plus years later they read it and they don't like it. oops? so now what? well, they want a special favor from president obama. and if they get it, someone is going to have to pay for it. that someone, that would be you. washington examiner chief political correspondent byron york joins us. okay. so where do we begin? what is it that the unions want? >> this is complicated. there is something called a reinsurance fee in obamacare. the deal is that insurance companies are going to have to start covering people with preexisting conditions, riskier cases than before. it's going to cost them more. what we didn't hear a lot about when obamacare was debated was that there was a provision in it which would pay these insurance companies billions of dollars to cover those

risks. >> so there was no risk to the insurance companies at all. >> exactly. >> can i tell you that is -- i mean, that's unbelievable. but anyway. >> so the way it's done is -- the government for three years 2014, 2015, 2016 will levy a fee on insurers. $63 a person. >> you pay 63. >> i pay 63. >> raise about $25 billion in this -- in 2014. now, the unions are called self-insured and self-administered plans. the unions, a lot of these big unions they don't go to an insurance company for their insurance they do it themselves. and they don't want to pay the $63 per person fee. and they have asked the white house for relief. it appears that the white house is preparing a rule that will specifically exempt these unions. these self-administered plans which will apply only to the unions, basically.

and they will get out of it. >> you know, it is stunning. i mean, this is absolutely stunning. here are the unions are the ones who are pushing this so much. and now they're asking for a special deal which will just add more money to the american people because if they're not paying $63, you know, a head. then we have got to pick up the -- here is the other thing which slays me. get out aer year. money we are collecting it's 12 billion in 2014, 8 billion in 2015. 5 billion in 102016. big bulk. if they get out the first year. makes it even worse. >> that's right. look, the unions you said in your intro, i mean, they did a lot to help pass obamacare. they did a lot to help elect president obama in 2008 and 2012. they want some favors. they got some in obamacare. remember that cadillac tax that's going to apply to insurance policies with a lot of features they got that delayed for a while. >> special favor.

they got it, nobody else did. >> they have already gotten some special favors. this would be a huge, huge favor. this is political there is no reason to do this at this point for these unions except get out the vote next time for the president, obviously the president can't run again. but totally political. and this extra cost goes on every other american. >> yeah. and it's interesting because, as far as the politics of it are concerned, a lot of republicans don't like this tax. they don't like anything about obamacare. they don't like this tax. a lot of other businesses don't really like it. they wish they didn't have to pay it. but, they dent want to see an exemption specifically for one group that is the president's supporters and the unions. >> so the rest of the america just picks up the freight because they are not as organized as the union to make sure they get out the vote so powerful as a voting block. >> that's it. >> so unfair. special note, obama

that's what the affordable care ability is all about. >> but now the bad news. turns out of the washington state health exchange made a big mistake. wire reporter is here with the rest of jessica sanford's story. good evening, eric, tell me what is the rest of the story? did something happen to that great deal insurance for her? >> within just a few days of that speech in the rose garden in front of the white house, jessica sanford started to get a terrible surprise. what happened was that the washington state health exchange made a terrible mistake in its calculations. everybody who signed up for health insurance policy and purchased it with government subsidies through during the first 23 days of operation of the web site the figures were all wrong. that was just the start. not too long ago, just last week she got another letter from the state healthcare authority saying that she doesn't qualify for any subsidy whatsoever. and what that means is that suddenly she can't afford health coverage.

she is going to go without. >> so she is going to pay that $95 tax; is that right? >> she says that she has no choice. the trouble is that the insurance policies that are available under obamacare when you don't have the tax credit, they are simply too expensive. the best you can get is a bronze plan, deductibles are are so high she wouldn't be able to afford the health insurance. so, in some respects, it's a washington state problem with the problems they have got on the web site. but also it raises the question how affordable is the affordable healthcare act in the first place? >> as a side. the original mistake this is a state created exchange not a federal. believe me i'm wig to blame the federal when appropriate. besides the problem with the program that misunderstanding was originally the washington state exchange but that is pratt and apart from the affordable for her once she got through all the exchange

issues, right? >> that's right. and washington is one of the 14 states across the country that did develop its own exchange. so it's a little bit separate from the federal troubles in that respect. but, also, we do have that big uber arching national issue, too. >> how does she feel about all of this? >> she is terribly embarrassed. just think, your name is used by the president on national television. you are held up as an example of suddenly the affordable care act is going to help. suddenly the rug is yanked out from underneath you. she says while that was one of the most proudest moments of her entire life, right now she feels like crawling underneath a rock. >> well, it certainly is -- i can imagine exciting to be called out by the president from the rose garden, this is a grim answer to her. she ends up with no insurance and a tax. eric, thank you. >> thanks. >> coming up, disturbing news about the lead contractor for healthcare.gov and you thought it couldn't get worse, right? stand by, that is next.

story in the "the washington post." tell me healthcare.gov has problems? >> healthcare.gov not only has problems but the problems are very similar to the problems that this medicine says sore company that cgi had american management systems. ams as you said. >> what is cgi's problems? >> well, i mean the problems with healthcare.gov glitches, you know, sending out wrong information and the system is built by this predecessor company of which many executives now work at cgi had similar problems for example this ams built a computer for the philadelphia school system and it wound up sitting paychecks to dead people, to dead employees. it put in a system for the defense logistics agency and wound up shipping military parts to the wrong vendors around the country because the system had wrong information which is somewhat similar to what he would seeing now. >> did cgi come in and buy ams and clean it up in 2004

and did it clean it up. >> that's what they say. we looked into cgi's recent history as well. they have been better. they haven't had as many problems as that period. they still have had some problems as well. in fact another subsidiary of cgi which grew out of this ams was primary builder of three of the state exchanges in hawaii, colorado and investment those have had major dliches as well. >> how does cgi get these contracts? is this the best we can do? >> well, i knew upper going to ask that that's an interesting question. we don't know for sure. what we do know is that they had done a lot of work with the department of health and human services in the past. at a mum mum it seems like they knew them. they weren't always happy about their work because i wrote about another previous contract where hhs had rejected them because of performance issues in a previous contract. there is more to be told about how they got the contract. >> do they at least guarantee their work or are we paying them more when they did don't do a good job. >> that's up in the air

right now. i think we are certainly probably going to wind up paying more in the end to fix this web site. but i think at this point they are just trying to fix it and they will figure out the money later. >> are we continuing to give cgi contracts? >> cgi has gotten $2.3 billion in contracts just in the last two years. since they were awarded the obamacare contract. so, yes. whether we are going to continue to give them contracts is another story, but a lot of federal agencies have used this contractor and hired them repeated. >> i are there a lot of cgis out there for other agencies? we are hearing the horror story of this web site. >> right. >> is this just like washington? >> it's not uncommon. i mean, to have it failures. it happens. >> is it to have companies that have a history of having mistakes that we keep hiring them over and over? >> yeah. i think it has happened before. what was unusual here was when you look back at the amf period and remember former amf executives runs the cgi federal.
